I work for an at will non profit organization in Illinois and have been employed for 10 months. I’m interested in applying for a recently available position which I’m qualified. I have exceeded the 6 month probationary period. Unfortunately, our policy manual states employees can’t apply for any position until we’ve worked in our current position for a year. The policy is not mentioned in my signed employee contract. Does the Illinois at will laws impose a “year wait” eligibility time period for applying for an open position? If not, does the law supersede the company’s policy manual?
