Contractor vs employee

Hi – I have a question – I’ve been interviewing with a company to become their first Product Marketing and Sales Director. My first few months would be setting up departments, process, hiring etc. After 3 interviews they told me that they want to start off by hiring me as a contractor for a few months to ‘kick the tires’. Based on the DOL’s criteria for contract work vs employee work…to me this falls into the category of employee work. I’m not set up to be a contractor, i have no other clients etc. I like doing things the right way and feel that my role is being missclassified and I’m not comfortable with that especially since i’m an international remote hire and would need to work with an employer of record to be hired. I fear that a misclassification of the role could become a bigger issue as i’m an international hire. Am i worrying for nothing or does this sound off?
