According to court documents, employees of RCM Technologies are eligible to receive payments under the terms of an unpaid overtime class action settlement. Lead plaintiffs Genoa Sosa and Jermaine McNeal filed that class action lawsuit in July of 2016. Both primary plaintiffs worked for RCM Technologies as hourly compensated consultants. The plaintiffs allege RCM Technologies illegally misclassified some of the company’s employees as exempt from overtime pay, which violates the federal Fair Labor Standards Act (FLSA), as well as California and New York labor laws, Sosa and McNeal charge RCM Technologies with the failure to pay regular wages, failure to reimburse employees for business expenses, and failure to provide legally binding wage documentation. Despite the class action settlement, RCM Technologies denies all of the plaintiff allegations.
With the help of a mediator, both parties worked out a class action settlement in March of 2017. Originally, McNeal and Sosa wanted to recoup lost wages and business-related expenses. Under the terms agreed to in the class action settlement, RCM technologies has agreed to pay at least $200,000 and as much as $327,000, as well as the company’s share of payroll taxes. RCM Technologies also must make separate payments to cover plaintiff attorney fees and litigations expenses. The class action settlement does not force RCM Technologies to admit liability for not paying overtime or reimbursing business expenses.

The New York Class consists of persons who worked for RCM Technologies while living in New York from July 13, 2010 to March 16, 2017. The California Class consists of persons who worked for RCM Technologies while living in California from July 13, 2012 to March 16, 2017. The FLSA Class consists of persons who worked for RCM Technologies while living in a state other than New York or California from July 13, 2013 to March 16, 2017. Class members can expect the potential award to be at least $250, with the amount depending on the number of valid and timely claim forms submitted. The deadline to file a claim form is June 9, 2017. Class members can download the claim form by accessing the class action settlement website www.McNealvRCMSettlement.com. The judge for Jermaine McNeal and Genoa Sosa v. RCM Technologies Inc., Case No. 2:16-cv-05170, in the U.S. District Court for the Central District of California has set the final hearing date for July 10, 2017.
