Real Time Resolutions has agreed to a class action settlement that alleges the company violated several provisions mandated by the landmark Telephone Consumer Protection Act (TCPA). The TCPA originally addressed the annoying practice of telemarketers making unauthorized telephone calls. After passing the TCPA, the United States Congress has added several amendments that expand the legal breadth of the do not call law.
The TCPA prohibits companies and non-profit organizations from making unsolicited telephone calls by using automated dialing systems that project real or artificial recorded voices. Primary plaintiff Michelle Lee Tannlund claims she received numerous telephone calls on her cell phone from Real Time Resolutions. Real Time Resolutions allegedly made the phone calls by using an automated telephone dialing system, which delivered sales pitches via a recorded artificial voice. Tannlund insists she never provided Real Time Resolutions with her call phone number and thus, the telephone calls violated the TCPA.
Real Time Resolutions continues to deny the allegations made by Tannlund in the class action lawsuit. However, the company has agreed to the class action settlement to avoid costly litigation that might produce an outcome in the favor of several plaintiffs filing separate class action lawsuits. According to court documents, Real Time Resolutions will pay about $1.3 million to settle the TCPA class action lawsuit. A judge granted preliminary approval of the class action settlement on April 10, 2017.

According to class counsel, class members include “All living persons in the United States (1) who received a phone call from Defendant during the Class Period to a number assigned to a cellular telephone service at the time the call was made, (2) where the number was uploaded to and dialed by Defendant’s telephone system, and (3) who did not give his or her express consent prior to such call being placed.” You might be eligible for compensation, if you received a telephone call from Real Time Resolutions between August 30, 2009 and April 10, 2017. The potential award for class members is about $25, with the final approved amount depending on the number of valid and timely claim forms filed.
Eligible class members have until July 24, 2017 to contest any part of the class action settlement or opt out of the agreement. The deadline for filing a claim form is August 23, 2017, which is also the date the judge has scheduled the final hearing for the class action settlement.
