Eligible class members comprise every Missouri resident who purchased an Aero Knife and did not receive a refund for the product. Missouri consumers who are eligible for class member status had until June 6, 2017 to contest any part of the settlement or decide to opt out of the class action agreement. The potential award in the settlement is a full refund for the purchase of an Aero Knife. Missouri consumers who seek a complete refund must send the Aero Knife with the submission of a valid claim form to the Claims Administrator. If you want to keep the Aero Knife, the potential award in the settlement is a maximum of $5.
Primary plaintiff Amy Rehak filed the Missouri Aero Knife class action lawsuit against Telebrands on behalf of numerous other plaintiffs that alleged the knife manufacturer made misleading statements in regards to its Aero Knife. The class action lawsuit mentions the use of the “As seen on TV” phrase that does not deliver the same product as seen in the commercial.
The plaintiffs assert Telebrands engaged in illegal practices that “constitute deception, fraud, false pretense, false promise, misrepresentation, unfair practices or the concealment, suppression or commission of material facts in connection with the sale and/or advertisement of the Aero Knife.” Under the agreement reached by attorneys for both sides of the class action lawsuit, Telebrands is offering Missouri consumers who bought the Aero Knife a complete refund. Missouri consumers must return the Aero Knife to the Claims Administrator to receive the full refund. Telebrands has also agreed to refrain from falsely promoting the knife as a “$50 knife for $10.”
Class counsel expects Rehak to earn an incentive award for filing the false advertising class action lawsuit against Telebrands. The amount of the incentive award for Rehak is expected to be around $10,000. Telebrands has created a settlement fund that includes more than $200,000 to cover attorney fees. A judge preliminarily approved the class action settlement on March 8, 2017.
The deadline to file a valid claim for a full refund or payment of $5 is July 12, 2017. The judge presiding over the class action settlement case called Amy Rehak, et al. v. Telebrands Corporation and Walgreen Co., Case No. 1522-CC10756, in the Circuit Court of the City of St. Louis, State of Missouri set the date for the final hearing on June 20, 2017.
