The Lawsuit claims that the Defendants discriminated against consultants and clerks with a Disability and that as a result of such discrimination violated the West Virginia Human Rights Act. The Defendants deny that they discriminated against any consultants or clerks, or any other employees. The Defendants believe they complied with all applicable federal and state laws and regulations at all times, and they have asserted various defenses to the claims.
The Settlement Agreement provides that if the Court gives its final approval, Verizon and Frontier will deposit $6,520,000.00 in a Settlement Fund. After subtracting a Court-approved Fee Award and Incentive Awards, Participating Settlement Class Members who meet the requirements of the Settlement Agreement and submit Claim Forms are eligible to receive a Settlement Payment from the Net Settlement Fund. After the Settlement Payments have been made, any remaining amount in the Net Settlement Fund will be donated to the Jobs Accommodation Network or another Court-approved charitable organization.
Defendants will also pay Administration Expenses to the Claims Administrator separate from the Settlement Fund. The Class Representatives and Settlement Class Members who do not Opt Out of the Settlement Class will Release the Released Parties from all Settled Disability Claims whether or not they submit Claim Forms. Settlement Class Members who Opt Out do not Release any claims.
Who’s Eligible
“The Settlement Class includes all present or former employees of Verizon and/or Frontier who worked as consultants or clerks in a Call Center at 425 South Holden Street, Clarksburg, West Virginia 26301 and/or 1500 MacCorkle Avenue, South East, Charleston, West Virginia 25314, between July 20, 2009 and November 9, 2016, and who at any time during that period had a Disability and were subject to discriminatory treatment or a hostile workplace because of their Disability.”
Potential Award
Up to $15,000.
The amount Class Members will receive depends on whether they submit a claim for Pool A or Pool B, and the total number of claims filed.
Class Members who file a Pool A claim may receive a settlement payment of up to $15,000. Class Members who file a Pool B claim may receive a payment of up to $2,000.
Proof of Purchase
N/A. Class Members who file claims for the West Virginia disability settlement must provide all required documentation with their Claim Form. The Claim Form must be notarized.
