Hyland’s has received negative media scrutiny for the recall of the company’s teething tablets. Flying under the media radar is the settlement of a class action lawsuit that involves numerous Hyland’s products.
Hyland’s Inc. recently agreed to settle a class action lawsuit that alleges the company engaged in false and misleading advertising in regards to the health benefits of its line of child homeopathic products.

- Baby Teething Gel
- Cold ‘n Cough 4 Kids
- Baby Infant Earache Drops
- Sniffles ‘n Sneezes 4 Kids
- Nighttime Cold ‘n Cough 4 Kids
- Cold Relief Strips 4 Kids with Zinc
- Complete Flu Care 4 Kids
- Baby Nighttime Tiny Cold Syrup
- Cough Syrup with 100% Natural Honey
Primary plaintiffs Enzo Forcellati and Lisa Roemmich filed the class action lawsuit, which asserts Hyland’s issued false and misleading claims about the benefits of the listed products in violation of both state and federal laws. The plaintiffs allege the false and misleading benefit claims include the phrase “provide fast, safe and effective relief from cold and flu symptoms.” Central to the arguments made in the lawsuit is that homeopathy is quasi science and Hyland’s homeopathic products “contain highly diluted concentrations of the ingredients listed as active ingredients.”
Hyland’s has repeatedly denied violating any state or federal law, but the company settled the class action lawsuit to avoid the uncertainty of protracted litigation.
What You Need to Know
Eligible class members have until June 28, 2017 to opt out of the class action settlement or contest one or more sections of the legal document. According to the case website www.HylandsLawsuit.com, Hyland’s class member “include anyone who, between March 8, 2008 and March 30, 2017, purchased any of the following Hyland’s products: Cold ‘n Cough 4 Kids; Cough Syrup with 100% Natural Honey; Sniffles ‘n Sneezes 4 Kids; Complete Flu Care 4 Kids; Baby Teething Gel; Baby Cough Syrup; Baby Gas Drops; Baby Infant Earache Drops; and Baby Nighttime Tiny Cold Syrup.” The potential award is a full refund for every one of the products mentioned in the class action lawsuit. Class members do not have to submit a receipt to prove the purchase of any of the Hyland’s products.
The deadline to file a claim form for the case legally referred to as Forcellati v. Hyland’s Inc., Case No. 12-cv-1983 ODW (MRW), in the U.S. District Court for the Central District of California is June 28, 2017. Class members for the Hyland’s settlement will attend a final hearing on August 14, 2017. L.
