The Hain Celestial class action lawsuit alleged some of the JASON products present a clearly recognizable label that tells consumers the products “No SLS, parabens, phthalates, petroleum, or artificial colors. SLS represents an artificial ingredient incorporated into several personal hygiene enhancement products. Prolonged exposure to sodium lauryl sulfate (SLS) can cause long-term negative health complications, while short-term exposure might irritate the skin, eyes, and respiratory system
On March 10, 2016, The Wall Street Journal ran a story describing the commissioning of two independent laboratories to conduct tests that eventually found inordinate levels of SLS in JASON products. According to class action lawsuit documents, a large number of chemists concur that the primary agent in sodium coco sulfate is SLS.
The lead plaintiff in the class action lawsuit asserted JASON promoted company products by making the “No SLS” claim, when in fact, most of the products include sodium coco sulfate. Because of the scientific tests, Hain Celestial Group and JASON Natural Products Inc. have agreed to pay $1.1 million to settle the class action lawsuit. However, neither Hain nor JASON admits to any of the lawsuit allegations. Both defendants settled the class action lawsuit to avoid the high cost of an extended court battle.
What You Need To Know
Eligible class members include consumers who purchased one or more of the line of JASON cleaning and personal hygiene products between August 17, 2011 and June 2, 2017. According to class counsel, the JASON products listed in the class action settlement are JASON Natural Product Long & Strong Jojoba Pure Natural Shampoo, JASON Volumizing Lavender Shampoo, JASON Normalizing Tea Tree Treatment Shampoo, JASON Dandruff Relief 2 in 1 Treatment Shampoo & Conditioner, and JASON Smoothing Coconut Body Wash. Eligible class members have until August 14, 2017 to opt out of the settlement or challenge any part of the agreement.
The potential award available for each class member is as much as $40. You have to submit proof of purchase for each JASON product covered by the class action settlement to receive $8 per product, up to a maximum of five products. If you do not submit proof of purchase receipts, you receive $2 per product, up to five products. Proof of purchase receipts accompany valid and timely claim forms, which class members must submit by September 18, 2017.
The class action settlement case Lori D. Gordon v. The Hain Celestial Group, et al., Case No. 1:16-cv-06526-KBF, in the U.S. District Court for the Southern District of New York has the final hearing scheduled on September 22, 2017.
