UNIVERSAL NUTRITION ‘MADE IN USA’ SUPPLEMENT CLASS ACTION SETTLEMENT

On March 21, 2016, Plaintiff filed this Action on behalf of himself and all others similarly situated alleging that Defendant violated California state law by improperly labeling and selling its products as being “Made Proudly in the USA,” or some derivative thereof. Plaintiff does not claim that the Product caused anyone physical injury or harm. Defendant denies any wrongdoing or liability arising out of any of the facts or conduct alleged in the Action and believes that it has valid defenses to the allegations. The Court has not decided that Defendant did anything wrong, and the settlement does not mean Defendant broke the law. Both the Plaintiff and Defendant believe that the settlement is fair, adequate, and reasonable and that it is in the best interests of the Settlement Class.

If you wish to file a claim to receive monetary compensation as described in the Settlement Agreement, you must submit this Claim Form to the Settlement Administrator, ILYM Group, Inc. The Claim Form must be completed, signed, and received by ILYM Group, Inc. if filled out and submitted online, by June 10, 2017, or if returned by mail to ILYM Group, Inc, it must be postmarked by June 10, 2017 for it to be considered timely. To qualify for monetary compensation, you must attest to the fact that you purchased a “Class Product” for personal use, and not for resale, in the United States from March 21, 2012 until December 28, 2016. Additionally, you must not be an officer, director, or employee of Universal, or the immediate family member of such a person, and must not have received remuneration from Universal in connection with the use or endorsement of the Class Products. A complete definition of the class qualifications and class terms, including the “Class Products” is provided in the Settlement Agreement, which is available at www.universalclasssettlement.com

Who’s Eligible

Class Members include anyone who purchased for personal consumption one of the eligible Class Products in the United States between March 21, 2012 and Dec. 28, 2016.

NOTE: Class Products include supplements that include a “Made Proudly in the USA” label from the following Universal brands: Universal Nutrition, Universal USA and/or Animal Pak.

Potential Award

Up to $20.

Proof of Purchase

N/A. Claimants must attest that they purchased one or more of the Class Products during the Class Period.
