NORTH CAROLINA WESTERN SKY, CASHCALL PAYDAY LOAN SETTLEMENT

North Carolina residents who entered into loans originated by Western Sky Financial, LLC (“Western Sky”) are entitled to relief from a settlement with the State of North Carolina through the Attorney General and the Commissioner of Banks that was approved by the Wake County Superior Court on June 15, 2016. Pursuant to the settlement, eligible borrowers will receive cancellation of any loan owned by Defendants and a credit history adjustment removing information relating to these loans. Certain borrowers will also receive a monetary payment.

Dahl Administration, LLC is the third-party payment administrator for the settlement.

Any North Carolina resident who entered into a Western Sky loan and who is eligible for a monetary payment under this settlement will be mailed a notice from Dahl providing the payment amount and explaining the process for filing a participation form. Initial notices mailed on August 12, 2016.

All North Carolina residents who receive a notice from Dahl in the mail are required to file a participation form in order to receive the payment that is owed to them. If you have relocated, or think you may have relocated, since the time you entered into your loan, you should contact Dahl at [email protected] or 1-855-253-5197 to update your mailing address.

North Carolina borrowers are no longer required to make payments on the Western Sky loans that are covered by this settlement. When the Court’s Judgment was entered on June 15, 2016, the Defendants were ordered to immediately cancel these loans and forgive any remaining balances.

Who’s Eligible

If you took out a loan from Western Sky Financial (also known as CashCall) and you lived in North Carolina at the time, you are entitled to benefits from the Western Sky settlement.

Potential Award

In addition to receiving cancellation of any loans owned by the defendants, eligible borrowers will also receive a credit history adjustment to remove any information related to the loans.

If you repaid an amount equal or greater than your loan proceeds plus 16 percent interest per annum, you may be entitled to a refund. Refunds will be issued on a pro rata basis.

For those who qualify for a refund, the refund amount is included on the notice and Participation Form documents that were mailed to eligible claimants. Click here to find out how pro rata refunds will be calculated.

Proof of Purchase

N/A. Claimants must enter their 8-digit Claimant ID printed on the Notice Letter. If you did not receive a Notice Letter but you believe you are entitled to a refund from the Western Sky settlement, contact the Settlement Administrator.

NOTE: If you do not file a Participation Form by the deadline, you may still obtain your refund by contacting the North Carolina Treasurer.
