When a company makes a claim of creating an all natural product, the company should make sure the claim is true. Just ask Skeeter Snacks, which recently settled a class action lawsuit alleging the company made false and deceptive statements about the all natural ingredients in its extensive line of sweet snacks.
Primary plaintiff Mastane Shalikar submitted a legal challenge that asserted the packaging labels, marketing materials, and the sales of specified products violated truth in advertising laws by claiming certain Skeeter Snack products contain “All Natural” ingredients. However, independent tests revealed the presence of synthetic and artificial ingredients that include lecithin soy lecithin, anhydrous dextrose, and cocoa processed using alkali. Shalikar insisted in the filing of the class action that she would either have not purchased the products or paid a substantially lower price for the products.
Skeeter Snacks continues to deny the charges, but the company has agreed to settle the case to avoid the uncertainty of a civil trial. The judge presiding over the class action lawsuit preliminarily approved the settlement on June 12, 2017.
